FERRIS MFG. CORP. SETTLES TRADEMARK INFRINGEMENT LAWSUIT AGAINST DERMARITE


For Immediate Release BURR RIDGE, IL, October 14, 2009 -- Ferris Mfg. Corp., a leader in the wound care field and the maker of POLYMEM® brand wound care dressings, has settled a trademark infringement lawsuit in the United States District Court for the Northern District of Illinois, Eastern Division, against DermaRite Industries, LLC.

Ferris is known worldwide for its POLYMEM® and QUADRAFOAM® wound care dressings. Since 1989, Ferris has helped health care providers bring effective results to the wound healing process with THE PINK DRESSING® brand.

Settlement Provisions
The operative provisions in the Stipulated Consent Judgment are:
  • DermaRite has agreed to refrain from using Ferris' marks, and the marks "PolyFoam" and "Pink Foam Wound Dressing."
  • DermaRite has agreed to refrain from marketing a wound care dressing which has a pink coloring present throughout both the interior and exterior of the product.
